Payments
Cheque -
The final payment must be paid three weeks before the due date or collection
Late Bookings
Should a late booking be arranged at any time within three weeks of the time of the booked dated then full payment will be required at the time of booking.
Policy Statement
I am sure you will understand that I must have a strict Policy of no payment – no cake!
Once a final payment is made, the cake or cakes are your property, irrespective of whether your event is cancelled for any reason due to unforeseen circumstances.
However, in this situation, I will do everything possible to sell the cakes for you or at EBay auction with no guarantee of price to be recuperated. This is not always possible with sponge cakes.
The Boring Bits -
Payment Terms: Unless otherwise pre-
- The balance is due three weeks prior to the delivery date.
- Goods are delivered personally by me, or can be collected, provided cleared funds have been received by the agreed payment date and prior to despatch.
- Price:
The price is the price shown on the order confirmation.
Personal Delivery
Basically, I offer to delivery all cakes personally to ensure that there is never any damage.
I have never let a Bride down or anyone else for that matter.
Risk:
The risk in the goods supplied shall pass:-
- where the customer collects or arranges transport on delivery to the customer or its courier,
- where the goods are otherwise delivered to an address on the British mainland on delivery to that address
- arising after passing of the risk, up to the total amount due to Anne’s Cakes for All Occasions.
Property:
Until Anne’s Cakes for All Occasions has received full payment for all goods which we have supplied to the customer at any time, the goods shall remain the property of Anne’s Cakes for All Occasions.
VAT
No VAT is payable on any orders.
Defect:
Our liability in respect of defective goods is, except as set out in these conditions, limited to replacement of such goods and we will not be liable whether in contract or in tort for any consequential loss however arising except:
- in circumstances where such exclusion would fail to satisfy the requirement of reasonableness
contained in the Unfair Contract Terms Act 1977 or any statutory re-
enactment or modification, or - if the customer is a consumer within the meaning of the act.
Waiver:
These conditions can only be varied in writing signed by the sole proprietor of Anne’s Cakes for All Occasions.
No other person has authority to agree any variation on behalf of Anne’s Cakes for All Occasions.
These conditions prevail over any inconsistent terms and conditions offered by the customer.
Anne’s Cakes for All Occasions will not be bound by any standard or printed terms furnished by the customer in any of its documents, unless the customer specifically states in writing separately from such terms to apply and Anne’s Cakes for All Occasions accepts such notification in writing signed by the Sole Proprietor.
Deliveries by Courier:
Sorry, but I do not know of any courier that could safely transport something so precious this is why I do it myself.
